(Exemption for hearing procedure)
Article 60. The Minister of Transport shall give notice, when he convenes a hearing, under Article 15 paragraph 1 of Administrative Procedure Law (Law No. 88, 1993) not later than ten days prior thereto.

 

2. Any person who has received notice from The Minister of Transport under Article 15 paragraph 1 of Administrative Procedure law (including any person to whom the notice was considered to have reached under paragraph 1 of the said Article, hereinafter referred to as “person to be heard”, when he has appointed his assistant, shall submit to the chairman a document describing his address, name, and contents of testimony before the date of the hearing.

 

3. Any person to be heard shall, when there is a witness for him (excluding any participant to the procedure for the hearing under Article 17 paragraph 1 of the said Law, hereinafter referred to as “witness”) submit to the Minister of Transport a document describing the address, name and the contents of testimony of the witness by the day before the date of the hearing.

 

4. Any person, when he will speak or submit evidence, shall obtain permission for such from the chairman.

 

5. Any hearing on the date under the preceding paragraph 2 shall be convened in a public forum. However, this shall not be applied upon the request of a person to be heard in a (closed door) private hearing.

 

(Application for Aviation Medical Certification)
Article 61. Any person who will make an application for aviation medical certification under Article 31 paragraph 1 of the Law shall submit to the Minister of Transport or a designated aviation medical examiner an application for aviation medical certification (the one describing the results of the medical examination received at a medical institution, etc. which are designated by the Minister of Transport (hereinafter referred to as “a designated aviation medical institution”)
within one month prior to the application. Form No. 22) in triplicate (in duplicate in case where the application is submitted to The Minister of Transport).

 

2. The application under the preceding paragraph shall, except in the case of initial application for an aviation medical certification, be accompanied by the results of the last aviation medical examination.
